1305.07 SATELLITE SIGNAL RECEIVING ANTENNAS.
   (a)   Definitions. For the purpose of this section, the following definitions shall apply unless the context indicates or requires a different meaning.
      (1)   “Dish” means that part of a satellite signal receiving antenna characteristically shaped like a saucer or dish.
      (2)   “Dish-type satellite receiving antenna” also referred to as “earth station” or “ground station” means one or a combination of two or more of the following:
         A.   A signal receiving device (antenna, dish antenna or dish-type antenna). The purpose of which is to receive communication or other signals from satellites in earth orbit or other extraterrestrial sources.
         B.   A low noise amplifier (LNA) which is situated at the focal point of the receiving component and the purpose of which is to magnify, store, transfer and/or transmit electronic or light signals.
         C.   A coaxial cable the purpose of which is to carry or transmit such signals to a receiver.
      (3)   “Grounding rod” means a metal pole permanently positioned in the earth to serve as an electrical conductor through which electrical current may safely pass and dissipate.
      (4)   “Receiver” means a television set or radio receiver.
   (b)   Permit Requirement. No person, firm, partnership, corporation, trust or other legal entity shall construct an earth station without a permit; nor shall construction commence before a permit is issued in accordance with the Building Code.
   (c)   Application for Permit.
      (1)   The owner or occupant with written permission from the owner of any lot, premises or parcel of land within the Village, within any defined district of the Village, who desires to construct an earth station on such lot, premises or land parcel, shall first obtain a permit to do so from the Building Department.
      (2)   The Building Inspector shall issue such permit, provided the applicant submits a written application upon forms provided and approved by the Building Inspector and in addition thereto, provides a plot plan of the lot, premises or land parcel attached showing the exact location and dimensions of the proposed earth station; the exact location and dimensions of all buildings or structures upon said lot or parcel; construction plans and manufacturer’s installation requirements for proper wind force for the type of installation being proposed. Each application shall specify among other things, the name and address of the owner of the real estate; the applicant; the person who prepared the construction plans and specifications; and the person to be permitted to construct the proposed earth station.
      (3)   The application shall be submitted with the appropriate building permit fee and the application and additional drawings shall be reviewed by the Building Inspector.
   (d)   Type of Earth Station Installation Permitted.
      (1)   The vertical structure of a ground-mounted earth station shall not exceed a height of fifteen feet above grade.
      (2)   Pole-mounted earth station is to be mounted alongside an approved structure and the pole is not to exceed a height of five feet in a vertical position above the closest roof gable to the installation.
   (e)   Location of Earth Station.
      (1)   Ground-mounted.
         A.   No ground-mounted earth station shall be constructed in any front or side yard but shall be constructed to the rear of the residence or main structure located upon the lot.
         B.   No ground-mounted earth station, including its concrete base/slab or other substructure, or the extended edge of its dish, shall be constructed less than three feet from any structure, property line or easement.
         C.   No ground-mounted earth station shall be linked, physically or electronically, to a receiver which is not located on the same lot, premises or parcel of land as is the earth station.
         D.   All structural supports shall be of galvanized metal or treated to inhibit rust.
         E.   Wiring between an earth station and a receiver and/or power supply shall meet N.E.C. standards for underground installation.
         F.   Such ground-mounted earth station shall be designed and installed to manufacturer’s instructions and local Building Codes to withstand a wind force of eighty-five miles per hour without the use of supporting guy wires.
         G.   Any driving motor shall be limited to forty volts maximum power design and shall be encased in protective weather guards.
         H.   An earth station shall be grounded to meet local and N.E.C. standards.
      (2)   Pole-mounted.
         A.   No pole-mounted earth station shall be constructed in any front yard, but shall be constructed to the rear or the rear half of and to the side of the primary structure, or a secondary structure that has a minimum of 200 square feet as long as three feet.
         B.   No pole-mounted earth station shall be constructed less than three feet from property lines or easements to include the substructure, concrete base, slab or the extended edge of the dish.
         C.   The pole-mounted earth station dish shall be constructed of mesh- type material with a maximum diameter of ten feet or a solid dish which shall not exceed three feet in diameter.
         D.   No pole-mounted earth station shall be linked, physically or electronically, to a receiver which is not located on the same lot, premises or parcel of land as is the earth station.
         E.   Wiring between an earth station and a receiver and/or power supply shall meet N.E.C. standards for underground installation.
         F.   The pole and all structural supports shall be of galvanized metal or treated with a rust inhibitor and anchored at subgrade in concrete. It shall be anchored to the side wall of an approved structure so as not to let it turn in the concrete base. The anchoring to the ground and to the approved structure shall be so designed and installed to manufacturer’s instructions and local Building Codes to withstand a wind force of ninety-five miles per hour without the use of supporting guy wires or anchoring into the roof system.
         G.   Any driving motor shall be limited to forty volts maximum power design and be encased in protective weather guards.
         H.   An earth station shall be grounded to meet N.E.C. standards.

      (3)   Wall-mounted.
         A.   No wall-mounted earth station shall be constructed in any front yard, but shall be constructed to the rear or the rear half of and to the side of the primary structure, or a secondary structure that has a minimum of 200 square feet of floor space.
         B.   No wall-mounted earth station shall be constructed less than three feet from property lines or easements to include the mounting structure and the extended edge of the dish.
         C.   The wall-mounted earth station dish shall not exceed three feet in diameter.
         D.   The wall-mounted earth station shall be linked, physically or electronically, to a receiver which is not located on the same lot, premises, or parcel of land as is the earth station.
         E.   Wiring between an earth station and receiver and/or power supply shall meet N.E.C. standards for underground installation.
         F.   The mounting structure shall be of a manufactured design intended for this use, installed and anchored to the manufacturer’s instructions and local building codes, and made with galvanized metal or treated with a rust inhibitor.
         G.   Any driving motor shall be limited to forty volts maximum power design and shall be encased in protective weather guards.
         H.   The earth station shall be grounded to meet local N.E.C. standards.

   (f)   Earth stations abandoned, deteriorated or damaged shall be removed from any lot, premises or parcel of land within the Village or repaired or replaced so as to operate in a normal manner.
   (g)   Roof-mounted earth stations installed prior to this change shall be permitted to remain so long as they do not become abandoned, deteriorated or damaged. If this occurs, they shall be removed and if re-installed, must meet the most recent standards adopted by the Village.
   (h)   Appeals. Appeals from a decision of the Building Inspector shall be made to the Board of Zoning Appeals as provided by Chapter 1143 of the Codified Ordinances.
   (i)   Penalty. Whoever violates any of the provisions of this section shall be fined not more than two hundred fifty dollars ($250.00). A separate violation shall be deemed to have been committed each day during or on which a violation occurs or continues to occur.
