(a) Application for permission to make street openings or trenches shall be made in writing to the Street Commissioner of the Village, upon such forms as shall be provided by the Commissioner and approved by Council. The application shall give the location of the proposed street opening or trench, along with the name and address of the applicant and any other information deemed pertinent by the Commissioner.
(b) The application shall include a clause whereby the applicant agrees to indemnify and hold harmless the Village from all loss or damage that may result from the making of such opening or trench, and, in the event the restoration is made by the applicant, such clause shall cover loss or damage resulting from the restoration and maintenance of the restoration.
(c) Upon payment of the fee hereinafter provided for, the Commissioner shall issue a written permit to make such opening, provided, however, that no permit to make any opening or trench in the paved portion of any street or sidewalk shall be issued within three years from the date of completion of paving such street or sidewalk without the permission and the approval of Council.
(d) In case of an emergency created by a break in any service or utility line or any sewer or drainage pipes beneath the surface of any street, alley, sidewalk or public way, the Commissioner may authorize any street opening or trench deemed by him to be necessary without a formal application and without any approval hereinbefore provided.
