§ 151.08 NOTICE AND ORDER TO VACATE.
   (A)   Issuance of order to vacate. If the Codes Enforcement Officer determines a building in the condition as to make it imminently dangerous to life, limb, property, or the safety of the public or the building’s occupants, the Codes Enforcement Officer shall issue an order to vacate, ordering the building be immediately vacated.
   (B)   Posting of order to vacate.
      (1)   Every order to vacate shall be posted upon each exit of the building and shall be in substantially the following form:

THIS BUILDING DEEMED UNSAFE FOR HUMAN OCCUPANCY
IT IS UNLAWFUL FOR ANY PERSON TO OCCUPY OR RESIDE IN THIS BUILDING
 
      (2)   Whenever the order is posted, the Codes Enforcement Officer shall also provide written notice and order to vacate to the owner and any occupants of the posted building containing the following information:
         (a)   The street address or legal description of the property sufficient to identify the premises upon which the building is located;
         (b)   A statement that the Codes Enforcement Officer has determined the condition of the building to be imminently dangerous to life, limb, property, or the safety of the public or the building’s occupants, and a brief description of the conditions found to render the building dangerous;
         (c)   A statement that the building has been ordered vacated, and that the building must be repaired or demolished, and a time within which the action must be taken;
         (d)   A statement advising that if the required action is not taken, the Codes Enforcement Officer may proceed to have the work done, and that the costs of the action shall be a lien against the property; and
         (e)   A statement advising that any person having record title or holding a legal interest in the building may appeal the notice and order, by filing a notice of appeal with the Codes Enforcement Officer within ten days from the date of service of the notice and order and that failure to appeal will constitute a waiver of all right to a hearing and determination of the matter.
      (3)   No person shall remain in or enter any building which has been so posted, except to repair or demolish the building under permit.
      (4)   No person shall remove or deface any order to vacate after it is posted until the required repairs or demolition have been completed.
