7-11-3: REFERRAL OF APPLICATIONS; APPROVAL OR DENIAL:
   A.   Referrals: Upon receipt of such application above described, the village clerk shall refer to the chief of police any application which has a maximum number of vehicles or animals expected to participate of twenty five (25) or less or a maximum number of persons expected to participate of one hundred (100) or less; and the clerk shall refer to the president and board of trustees any application which has a maximum number of vehicles or animals expected to participate of more than twenty five (25) or a maximum number of persons expected to participate of more than one hundred (100).
   B.   Action On Applications Referred To Chief:
      1.   On all applications referred to the chief of police, the chief of police shall determine whether that parade, procession, or march will unreasonably interfere with the rights of others to use the streets and sidewalks with respect to time, route, composition, or number of participants, and based upon this determination, the chief of police shall direct the village clerk to issue or deny a permit for the conduct of that parade, procession, or march.
      2.   In the event that the chief of police shall direct the village clerk to deny such permit, the chief of police shall designate the area or areas wherein the plan for the parade, procession, or march shall be appropriately adjusted, including the setting of a limitation on the number of persons allowed to participate, with the provision that a new application setting forth such changes in the plan be delivered to the chief of police within five (5) days of his direction to the village clerk to deny the permit.
      3.   In the event the person or group making application for a permit shall change the plan for the parade, procession, or march to conform to the designation of the chief of police, and provided the new application is received by the chief of police within the time limits set forth hereinabove for the submission of a changed plan, the chief of police shall direct the village clerk to issue a permit for that parade, procession, or march.    C.   Action On Applications Referred To Board Of Trustees:
      1.   On all applications referred to the board of trustees, the board of trustees shall determine whether that parade, procession, or march will unreasonably interfere with the rights of others to use the streets and sidewalks with respect to time, route, composition, or number of participants, and based upon this determination, the board of trustees shall direct the village clerk to issue or deny a permit for the conduct of that parade, procession, or march.
