A. Whenever in this code, or in any ordinance of the village, any act is prohibited or is made or declared to be unlawful or a misdemeanor or a violation of this code, or whenever in such code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful or a misdemeanor or a violation of this code, where no specific penalty is provided therefor, the violator of any such provision of this code or any ordinance shall be punished by a fine of not less than one hundred dollars ($100.00) nor more than one thousand dollars ($1,000.00). A separate offense shall be deemed committed each day any such violation of any provision of this code or of any ordinance shall continue.
B. Any penalty imposed for a violation of this code or any village ordinance that remains unpaid may be forwarded to a collection agency for collection. An additional one hundred dollar ($100.00) processing fee shall be imposed on all matters referred for collection.
C. In the event a fine or penalty is assessed pursuant any provision of this Code, a default in the payment of a fine or penalty or any installment of a fine or penalty may be collected by any means authorized for the collection of monetary judgments. The village and the village attorney or the finance director or their designees may retain attorneys and private collection agents for the purpose of collecting any default in payment of any fine or penalty imposed by this Code, or any installment of a fine or penalty. The village shall add a thirty-five percent (35%) cost of collections to any outstanding balance that requires the village to retain the services of a collection agency. This thirty-five percent (35%) cost includes any default in a fine or penalty or any installment of a fine or penalty that was previously referred to an attorney or private collection agency and the payment of which remains outstanding.
