5-6-5: SPECIFIC PROHIBITIONS:
The following acts, conduct and conditions are hereby declared and defined to be nuisances, and when committed, performed or permitted to exist by any person, firm, association or corporation within the territorial limits of the village, are hereby declared to be unlawful and prohibited:
   A.   Construction: It shall be unlawful to operate or permit the operation of any tools or equipment used in construction, drilling, or demolition work between the hours of nine o'clock (9:00) P.M. and seven o'clock (7:00) A.M. such that the sound therefrom creates a noise disturbance across a residential real property boundary, except for emergency work of public service utilities, public works projects, or by special variance.    B.   Emergency Signaling Devices:
      1.   It shall be unlawful to intentionally sound or permit the sounding outdoors of any fire or burglar alarm, siren, whistle, or similar stationary emergency signaling device, except for emergency purposes or for testing, as provided in this subsection. Testing of a stationary emergency signaling device shall occur at the same time of day each time such a test is performed, but not before nine o'clock (9:00) A.M. or after nine o'clock (9:00) P.M. or the closing time of a commercial establishment, whichever shall occur later. Any such testing shall use only the minimum cycle test time. In no case shall such test time exceed sixty (60) seconds. Testing of the complete emergency signaling system, including the functioning of the signaling device and the personnel response to the signaling device, shall not occur before nine o'clock (9:00) A.M. or after nine o'clock (9:00) P.M. In no case shall such test exceed ten (10) minutes.
      2.   It shall be unlawful to sound or permit the sounding of an exterior burglar or fire alarm or any motor vehicle burglar alarm unless such alarm is automatically terminated within two (2) minutes of activation or within a reasonable time after notification of activation.
      3.   It shall be unlawful to sound any horn or other auditory signaling device on or in any motor vehicle on any public right of way or public space, except as a warning of its approach, danger or an emergency.
   C.   Loading And Unloading: It shall be unlawful to load, unload, open, close, or to do other handling of boxes, crates, containers, building materials, dumpsters, garbage cans, or similar objects outside of a building or vehicle located within a loading berth between the hours of ten o'clock (10:00) P.M. and six o'clock (6:00) A.M. in such a manner as to cause a noise disturbance across a residential real property boundary. Fully enclosed trucks backed up to a loading berth are considered within a building and may be loaded and unloaded into and from a building at any time.
   D.   It shall be unlawful to collect, pick up or dispose of refuse, recyclable material, empty containers, dumpsters, drums, etc. between the hours of nine o'clock (9:00) P.M. and seven o'clock (7:00) A.M. in such a manner as to cause a noise disturbance across a residential real property boundary.
