A. Business License:
1. License Required: No corporation, partnership, sole proprietor or other business entity shall: a) operate an ice cream vending vehicle; or b) employ a person as an ice cream vendor within the village; or c) rent, lease or otherwise provide an ice cream vending vehicle to an ice cream vendor within the village without having first obtained an ice cream vending vehicle business license.
2. License Fee And Maximum Number Of Licenses: The fee shall be as provided in section 4-2-2 of this code. The maximum number of business licenses for the operation of an ice cream vending vehicle business is three (3). (Ord. 99-62, 7-8-1999)
B. Vending Vehicle License:
1. Maximum Number Of Licenses: The holder of a valid ice cream vending vehicle business license may apply for a maximum of four (4) ice cream vending vehicle licenses.
2. Sanitation Inspections: Prior to the issuance of an ice cream vending vehicle license and not less often than every thirty (30) days thereafter, the applicant shall submit the vehicle for a sanitation inspection by the community development director.
3. Insurance Requirements: Every ice cream vending vehicle operated within the village shall be covered by a policy of public liability insurance issued by a solvent and responsible insurance company authorized to do business in Illinois in a minimum amount of three hundred thousand dollars ($300,000.00) for bodily injury or death to a person and one hundred thousand dollars ($100,000.00) for damage to property. Each vendor shall provide the village with a certificate of insurance naming the village as an additional party insured.
4. State Certificate Of Inspection Posted: No vehicle shall be operated within the village as an ice cream vending vehicle unless there is affixed to the vehicle a valid state of Illinois certificate of safety inspection sticker.
C. Vendor License:
1. License Required: No person shall operate or act as an ice cream vendor within the village without having first obtained an ice cream vendor license.
2. Ineligibility For License: No ice cream vendor license shall be issued to a person who is a "sex offender" as defined in the sex offender registration act 1 .
3. Application For License: Applications for an ice cream vendor license shall be made to the village clerk, in writing, signed by the applicant under oath, or by affidavit to its truthfulness and accuracy, and shall contain the following information and statements:
a. The applicant's name, address and telephone number.
b. The applicant's date of birth, social security number, and driver's license number.
c. The applicant's fingerprints.
d. A statement that the applicant is not a sex offender as defined in the sex offender registration act.
e. A current passport size photograph of the applicant.
4. Investigation Of Applicant: An application received by the village clerk shall be forthwith forwarded to the police chief who shall determine whether the applicant complies with this subsection. (Ord. 2000-71, 9-7-2000)
Every applicant for a license under this chapter shall submit to fingerprinting and a background check and pay the village a fee of one hundred dollars ($100.00) to cover the cost of fingerprinting and the background check in order to verify the information provided in the application for license. 5. Issuance Of License: Upon receipt of confirmation from the police chief that the applicant complies with this subsection, the village clerk shall issue the license. The license shall be in the form of a photograph identification card. The photograph identification card shall be worn on the outer clothing of all ice cream vendors at all times while ice cream vending. (Ord. 2000-71, 9-7-2000)
