7-4-5: OPERATION OF CERTAIN VEHICLES PROHIBITED-LOCAL WEIGHT RESTRICTIONS:
   A.   Weight Limit Established: As provided for under the authority of 625 ILCS 5/15-01, 625 ILCS 5/15-111, and 625 ILCS 5/15-316, it shall be unlawful to operate any vehicle or combination of vehicles upon any public street or highway under the exclusive control of the Village when the operation of that vehicle is prohibited by a posted sign prohibiting the operation of that vehicle. Vehicles operating under the authority of 625 ILCS 5/15-101, 625 ILCS 5/15-111 or 625 ILCS 5/15-316 while utilizing Village roadways under "reasonable access" rules will be considered in violation of this Section if they are not utilizing the most direct route to points of loading and unloading.
   B.   No vehicle or combination of vehicles shall be operated, with or without a load, upon any posted public street or highway under the exclusive control of the Village if the actual gross weight, gross vehicle weight rating (GVWR), gross combined vehicle weight rating (GCWR), or registered gross vehicle(s) weight thereon exceeds ten thousand (10,000) pounds.
   C.   Exceptions:
      1.   Vehicles making deliveries or pickup of materials or products to or from local residences, hospitals, or governmental buildings.
      2.   Vehicles operating under a category 2 limited continuous operating overweight permit authorized by the Glendale Heights Police Department.
      3.   Refuse and recycling vehicles contracted by the Village to perform waste and recycling collection between the hours of seven o’clock (7:00) a.m. and nine o’clock (9:00) p.m.
   D.   Prima Facie Evidence: If a vehicle displays registration above ten thousand (10,000) lbs., it shall constitute prima facie evidence that the vehicle is in violation of the limitations of the Section.
   E.   Signs Posted: The Director of Public Works is hereby authorized and directed to cause the posting of signs at the entrances to and upon such public streets and highways so as to give reasonable notice of the provisions of the Section.
   F.   Penalties: Any driver or owner of a vehicle operated in violation of the Section shall be subject to a fine of not less than two hundred fifty dollars ($250.00), but not more than seven hundred fifty dollars ($750.00).
