1-14-2: ANNEXATION FUNDS:
   A.   Fees For Petitions To Annex:
      1.   Established: No land shall be annexed to the village except upon the payment of both a nonrefundable application fee and an annexation fee as set forth in chapter 15 of this title. (Ord. 2011-82, 10-20-2011; amd. Ord. 2014-63, 10-16-2014)
      2.   Payment; Refunds: Such fees shall be paid by the owners to the village clerk upon the filing of the petition to annex. The annexation fee, but not the application fee, shall be refunded to the owners of the property in the event that the village president and board of trustees fail to act upon the petition to annex within one hundred twenty (120) days following the filing thereof, or if for any other reason the requested annexation fails to be completed.    B.   Annexation Agreement; Deposit Requirements: Where an annexation is conditioned upon the execution of an annexation agreement, the owner or petitioner, in addition to the foregoing fees, shall be responsible for payment to the village the following cash deposit to be applied against all costs and expenses incurred thereby with regard to such annexation agreement including publication costs of legal hearing notices and fees paid to the village attorney and village engineer for drafting, review, inspection and other related services; said costs to be payable when incurred and to be nonrefundable. Any costs and expenses incurred in excess of the following cash deposit shall be invoiced by the village to the owner or petitioner who shall be responsible for payment of the invoice upon its receipt. Any unused portion of the cash deposit provided in this subsection shall be refunded to the owner of the property or petitioner upon annexation or in the event that the village president and board of trustees fail to act upon the petition to annex within one hundred twenty (120) days following the filing thereof, or if for any reason the requested annexation fails to be complete.

   C.   Proof Of Payment: No petition for annexation or annexation agreement shall be considered until the owner or petitioner has first exhibited a receipt of the village clerk showing payment of the fees and, if applicable, the cash deposit provided in this section.
   D.   Application Of Fee And Deposit To Other Zoning Situations: If the owner or petitioner should apply for a zoning amendment, conditional use, variance or a planned unit development in addition to annexation, only one application fee and cash deposit shall be required. (1978 Code § 1-11-4)
