1-9-6: SUBDIVISION, ZONING AND SITE PLAN REVIEW FEES:
The subdivider shall pay the fees listed below to the Department of Building and Zoning at the time of application. The Finance Department shall promptly cause such fees to be deposited in the Village’s General Corporate Fund.
   A.   Preliminary Plat Review: in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code for each lot (the “minimum review fee”) or the actual costs incurred by the Village for engineering review, whichever is greater. If the actual costs incurred by the Village for the engineering review are greater than the minimum review fee the Village shall show proof of such costs to the subdivider and the subdivider shall pay the difference prior to submittal to the Planning & Zoning Commission for review.
   B.   Civil Improvement Plan Review: The developer shall pay a minimum review fee in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code plus any additional documented costs paid by the Village for the review if the Public Works Director or Engineer will be performing the review. The payment of review fees charged by the Village shall be made at the time of application submittal and prior to submittal to the Planning and Zoning Commission for review.
   C.   Final Plat Review: in the amount as shown in the Schedule of Fees found in 1-16-1 of the Village Code plus any additional documented costs paid by the Village for the review. The payment of review fees charged by the Village shall be made at the time of application submittal and prior to submittal to the Village Board for review.
   D.   Rezoning Request Fee: in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
   E.   Infrastructure Inspection and Observation Fee: in the amount as shown in the Schedule of Fee found in Section 1-6-1 of the Village Code. The amount shall be a in percentage equal the cost of improvements to be dedicated to the Village to cover the additional cost to monitor compliance with the subdivision control code, or the actual costs incurred by the Village for inspection services, whichever is greater.
   F.   Non-residential Subdivisions or Site Plan Review Fee: When a development plan is required in accordance with Section 11-5-12 of this code the developer shall pay a minimum review fee in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code plus any additional documented costs paid by the Village for the review. The payment of review fees charged by the Village shall be made at time of application. If the actual costs incurred are greater than the minimum review fee, the Village shall show proof of such costs to the subdivider and the subdivider shall pay the difference prior to the final plat submittal to the Village Board for review.
   G.   Zoning Application Submittal Fees:
      1.   Variance Requests and Appeal Requests: in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code for filing a variance from or appeal to the zoning ordinance. Due upon application submittal.
      2.   Zoning Amendment: for changes to a zoning district or the text of the zoning ordinance a fee in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code. Due upon application submittal.
   H.   Planned Development Procedure Special Use Submittal:
      1.   Application Fees: Due upon application submittal.
         a.   Residential: a fee in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
         b.   Commercial: a fee in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
      2.   Section Plans: a fee in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
   I.   Special Use Permit Other Than PDP: in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
   J.   Publication Costs: Required publication costs and mailing costs for public notice shall be paid by the applicant prior to public hearing date, if applicable.
   K.   Payment Of Fees: Until such fees have been paid, no request for any of the above shall be deemed to have been filed, and no procedure shall be initiated. (Ord. 2015-14, 4-14-2015; amd. Ord. 2021-23, 7-27-2021)
