§ 97.20 INSPECTION BY STREET DEPARTMENT.
   (A)   The filling of any cut or excavation upon a city street or sidewalk shall be inspected by the Street Department Superintendent or Assistant Superintendent to ensure that the standards of this subchapter are met.
   (B)   Upon a written certification by the Street Department Superintendent or Assistant Superintendent that the standards of this subchapter have been met, the surety bond given in connection with the application shall be released unless, at such time, the required surety bond posting of applicant, without considering the limitations of § 97.17, are in excess of $20,000, in which event, the bond shall remain in full force and effect. However, if the standards are not met, the application fee shall not be refunded but shall remain in a separate account maintained by the City Clerk/Administrator, which funds the Street Department may draw upon to ensure that all cuts and excavations of city streets are refilled in accordance with the specifications in this subchapter.
   (C)   If the standards of this subchapter are not met, and if the applicant does not correct such repairs within 15 days after written notice of the non-conformity, then the Street Department shall proceed to make the repairs and the cash bond deposited in connection with the application shall be paid to the account of the Street Department as reimbursement for the cost of those repairs or, in the event a surety bond has been posted in connection with the application, the cost shall be recovered from the surety.
