§ 97.17 APPLICATION FEE; BOND.
   (A)   The application for a permit shall also be accompanied with the payment of a cash fee of $25 and additionally with the posting of a cash bond in an amount equal to $25 per linear foot of street or sidewalk to be cut or excavated, or $150, whichever is greater; however, no bond shall be required of any municipally-owned utility or any utility regulated by the Public Service Commission of Kentucky.
   (B)   In lieu of the cash bond required by this section, a corporate surety bond, subject to the approval of the City Clerk/Administrator, may be used, the condition of the bond being that the surety thereon unconditionally obligates itself, in the penal sum of the bond, to the performance of all requirements imposed upon the applicant.
   (C)   The maximum bond required of any single entity with respect to street and/or sidewalk cuts shall be, in the aggregate, $20,000; provided that, each bond posted by the applicant be conditioned so as to secure the obligations of the applicant with respect to all applications then existing or thereafter made by the applicant.
   (D)   (1)   Every utility in the city, whether privately or municipally owned, shall notify the City Clerk/Administrator in writing 30 days in advance of an intended application for street and/or sidewalk cuts in connection with major construction projects.
      (2)   For the purpose of this division (D), the following definition shall apply unless the context clearly indicates or requires a different meaning.
      MAJOR CONSTRUCTION PROJECTS. Those which significantly affect pedestrian or vehicular traffic, other utilities or the availability of utility service to users thereof.
   (E)   The City Street Department shall, 30 days prior to the commencement of construction, give written notice to all gas, electric, water and sewer utilities affected by any proposed street or sidewalk improvement, new construction of streets or sidewalks or drainage projects.
   (F)   The City Clerk/Administrator shall furnish a copy of each application for street or sidewalk cut and excavation to the Superintendent of the Street Department at the time the permit is issued.
