§ 36.131 MEMBERS.
   (A)   The business and affairs of the water and sewer system of the city shall be exclusively supervised, managed and controlled on behalf of the city by a municipal Water and Sewer Commission of five members, of whom the Council representative described in § 35.132 shall be an ex officio member with the same voting privileges, compensation and other rights and privileges as any other member of the Commission. The other four members shall be appointed and shall qualify as follows:
      (1)   The Mayor, by and with the approval of the City Council by resolution duly adopted and recorded in its minutes, shall serve as a permanent member and shall appoint three residents of the municipality who have resided therein for not less than one year next preceding the date of the appointment as such municipal Water and Sewer Commissioners, and who have attained the age of 21 years; and
      (2)   Each Water and Sewer Commissioner, excluding the Mayor, shall be appointed for a term of three years, except the Water and Sewer Commissioners first appointed under this chapter shall serve for terms of one, two and three years respectively, the respective terms to be determined by the designation of the Mayor when the appointments are made. Any Water and Sewer Commissioner shall be eligible for reappointment upon the expiration of his or her term. Upon the expiration of the term of any Commissioner, the Mayor, with the approval and by the consent of the City Council, shall appoint a Commissioner to fill the vacancy, by reason of the expiration of the Commissioner’s term unless the vacancy is created before the expiration of the term in which event the appointment shall be for the remainder of the unexpired term.
   (B)   Each Water and Sewer Commissioner, exclusive of the Council representative described in § 36.132, shall receive a salary or compensation at the rate of $100 per month except the Treasurer whom shall receive $110 per month. The compensation shall be paid in monthly installments. The members of the Water and Sewer Commission may be removed by the City Council for non-feasance or misfeasance in office.
