765.02  LICENSE ISSUANCE; FEE(S); TERMS.
   (a)   No person shall individually, or by the use of carts, wagons, telephone, vehicles or other conveyance by going place to place upon the streets of the City, or by standing temporarily in one place upon any portion of a street, or any other premises owned by the City or temporarily or transiently open any store or other place for the purpose of: bargain to sell, expose for sale, give away or solicit orders for merchandise or services without first obtaining a license from the Mayor.
   (b)   Applicants for licenses under this chapter must file a completed application, be in total conformance with all other applicable City, State and Federal laws, rules and regulations, including those which require licenses and permits; and has made payment for one of the following licenses:
      (1)   Food service; establishment licenses must be obtained from the City Health Department where any products sold or given away, are food items whereas a license fee is required and established by Board of Health resolutions.
      (2)   Flea market or like market licenses may be granted by the licensing authority to organizations or individuals who, by the nature of their business, allow individual vendors or transient vendors to sell, or give away merchandise under one roof or in one contiguous area upon payment of a license fee of one hundred dollars ($100.00) per year.
      (3)   Organizational vendor’s licenses may be granted by the licensing authority to organizations, churches, schools, governmental organizations, hospitals, fraternal, veteran’s or like associations or any non-profit organizations transporting, selling or giving away merchandise and/or services upon payment of a license fee of one dollar ($1.00) per year.
      (4)   Transient vendor’s licenses may be obtained from the licensing authority upon the applicant’s supplying all of the following:
         A.   Written permission from the owner of the premises at which the transient business will be conducted setting forth the specific dates that such transient business shall be permitted upon those premises.
         B.   A certificate from the City Board of Health confirming that sufficient public sanitation facilities have been provided on the premises or immediately adjacent to the premises; and that written permission to use the sanitation facilities has been obtained from the owner wherein the facilities are located.
         C.   A certificate from the Building and Zoning Inspector of the City that sufficient off-street parking is provided on the premises, being the same off-street parking requirements for retail stores.
         D.   A certificate from the City Treasurer that the sponsor or owner of the transient business has the operation of this business enterprise within the City which certificate shall further require the sponsor, upon request of the City Treasurer or which certificate states that the sponsor or owner is exempt from taxation; and
         E.   The payment of a license fee in the sum of twenty-five dollars ($25.00) by the sponsor or owner of the transient business for each day that the transient business vendor shall conduct his business at any one particular temporary place of business, it being the intention to license each and every transient business vendor at each and every site or location of operation.
