No proceedings under this chapter may be maintained unless three members of the Hearing Board unanimously find that a public nuisance in fact exists. Furthermore, in the event of a summary abatement no such nuisance may be summarily abated until and unless the Board shall unanimously find that the summary abatement of such nuisance is necessary.
