The owner or owners of any premises or real estate on which alleged nuisance exists and upon whom notice has been served as provided hereinbefore, within ten days after receipt of such notice, the owner or owners may make a demand in writing to the Director of Public Services for a hearing on the question as to whether or not in fact, a public nuisance as defined in Section 523.01 exists or whether more than thirty days should be granted to the owner or owners to abate the nuisance. If a request for a hearing is made upon the Director, the hearing shall be held within ten days following receipt of the written demand and at least two days notice of the date of hearing shall be given to the owner or owners. This hearing shall be conducted by a Hearing Board comprised of the Director of Public Services, Fire Chief and Mayor, and in the event any of the aforementioned officials are unable to attend or serve on the Board, the remaining members shall have the right to select an impartial official to serve for the purpose of conducting this hearing. It is further provided that the three members of the Hearing Board must concur that a public nuisance as defined in Section 523.01 exists before enforcement of this abatement is carried out. A majority of the Hearing Board may amend or modify the notice and/or order, or extend the time for compliance by the owner or owners with any parts of the abatement by such date or dates as such majority of the Board determines. It is further provided that a copy of the decision and order of the Hearing Board shall be promptly served upon the owner or owners in the manner provided by Section 523.03. The decision of the Hearing Board and the order shall be final and conclusive unless the owner or owners file within ten days after the decision is rendered, an action in or an appeal from such order with the Municipal Court or to the County Court of Common Pleas. Otherwise, the order shall become final and conclusive at the termination of such action or appeal proceeding as determined by such court.
