(A) Eligibility for office. Any person who is a qualified elector in the village may hold any elected village office in the village. No member of the Village Board may, during his or her term, be eligible for any village office or village position which, during such term, the office or position has been created by or the selection to which is vested in the Village Board. Any member of the Village Board will be eligible for such village office or village position if he or she resigns from the Village Board before being appointed to the village office or village position and if the office or position created during his or her term in office.
(B) Incompatibility. Certain village offices are incompatible, by common law and statutory law, with other village offices and also with other county, state or federal offices.
(1) No village officer, by this section and the below noted cited authority, shall serve in both offices at the same time, namely (list office and cited authority): the Office of Village Treasurer and the Offices of County Treasurer or School District Treasurer.
(2) Note to users: this list is not inclusive. The common law doctrine of incompatibility extends to both officers and an office and position. OTRADOVEC vs City of Green Bay, 118 Wis. 2nd 393, 347 N.W. end 614 (1984). Consult the Village Attorney for additional advice.
(C) Review by Attorney. If any question or concern by any person is raised to the Village Board regarding incompatibility of any office in the village, the Village Attorney shall review the matter and shall provide his or her written comments to the Village Board.
