5-2-3-5: DUTIES OF ANIMAL CONTROL OFFICER; K-9 PATROL OR POLICE DOG EXEMPTION:
   A.   Upon being notified that a dog has bitten any person or is suspected of suffering from rabies, the animal control officer or the county animal control shall:
      1.   When the owner of the dog is known, notify such owner and direct such owner to deliver the dog to a licensed veterinary hospital for observation; or
      2.   When the owner of the dog is unknown, immediately take said dog and confine said dog to a licensed veterinary hospital for observation. (Ord. 708, 9-13-2012)
      3.   When a dog is taken under the provisions of subsection B of this section, attempt to notify the dog's owner of the confinement of such dog within seven (7) days after the confinement begins. (Ord. 708, 9-13-2012; amd. 2012 Code)
   B.   When a person or animal is bitten by a K-9 patrol dog or police dog that is currently vaccinated against rabies, the dog may continue to perform its duties for the peace officer or law enforcement agency, and any period of confinement for observation of the police dog may be under the supervision of a peace officer. The supervision shall consist of the dog being locked in a kennel, performing its official duties in a police vehicle, or remaining under the constant supervision of its police handler. Where such dog is not currently vaccinated against rabies, the procedure established by section 5-2-3-6 of this chapter shall apply in place of this section. (Ord. 708, 9-13-2012)
