4-3-1: DEFINITIONS:
As used in this chapter, the following words and terms shall have the meanings ascribed to them in this section:
NUISANCE GREENERY: Any weeds or grasses exceeding a height of six inches (6"), or any plants or vegetation, including trees, bushes, shrubs, flowers or ornamental plants, that unreasonably interfere with the health, safety, and welfare of the residents of the village or that unreasonably interfere with the use of and access to or poses a danger to the streets, rights of way, sidewalks, and utilities, including sewer lines, water lines, power lines, and other municipal infrastructure.
OWNER: The record titleholder of property as reflected in the office of the Woodford County recorder of deeds.
REASONABLE NOTICE TO ABATE: Service of a notice to abate on the owner by: a) personal service, as authorized by law for personal service of ordinance violations and complaints; b) certified mail addressed to the owner at the address to which the most recent tax bill was sent for the general taxes on the property for the taxable year immediately preceding the abatement of the nuisance greenery; or c) posting a sign regarding the violation of nuisance greenery on the property. Any notice to abate served on the owner shall include the name of the owner, the date of the violation, a short description of the violation, the location of the violation, a reference to the provision of this chapter violated, the date by which the violation must be abated, and any other information that may be required to apprise the owner of the violation or as required by law.
