4-2-7: DUMPING OR THROWING WASTE:
   A.   1. No person shall throw, deposit, or dump waste, or hire or cause another to throw, deposit, or dump waste, on any property except in a public landfill or when authorized by the owner or person in control of such property.
      2.   The owner of any waste shall be responsible for its placement on the property of others until it is delivered to a public landfill. Proof of ownership of any waste found on any property of another shall be prima facie evidence at the trial of a violation of this subsection. Evidence that the owner of the waste reasonably relied upon his agent or another to deposit his waste in a public landfill shall be an affirmative defense in any prosecution.
      3.   A violation of this subsection by the person who throws, deposits, or dumps waste, or by persons who hire or cause another to throw, deposit, or dump waste, will be punishable by a fine of not less than seventy five dollars ($75.00) and not more than seven hundred fifty dollars ($750.00).
   B.   No person shall throw or deposit any waste from a vehicle upon any public place except in public containers. (Ord. 653, 3-11-2010)
