4-2-5: COLLECTION AND DISPOSAL OF WASTE:
   A.   No waste shall be disposed of or placed within the village in any manner or place other than as prescribed by the village board.
   B.   The exclusive method for collection and disposition of municipal waste for each household unit shall be curbside and recycling pick up by any contractor employed or engaged for that purpose by the village. No person or entity who has not contracted with the village may engage in the business of collecting municipal waste or white goods within the village for any household unit. (Ord. 653, 3-11-2010)
   C.   There shall be a charge for collection of municipal waste to the owner and/or occupant of every household unit for which such service is provided by the village through contracts with a private hauler. Such fee shall be in the amount of twenty-one dollars ($21.00) per household unit per month, beginning on November 1, 2023. The collection fee shall be payable monthly as billed by the village or its billing agent. A penalty of ten percent (10%) shall be added to all bills not paid by the last day of the month in which the bill is sent. Failure to pay the fee upon billing by the village or its billing agent may result, at the village option, in the placement of a lien against the real estate and/or the filing of a complaint in circuit court seeking personal judgment against the owner or person interested in the property subject to the collection fee, plus court costs and reasonable attorney fees, or such other remedies as may be available to the village. The village hereby imposes an additional charge for recording a notice of lien in the amount actually charged by the office of the county recorder of deeds, and an additional charge of twenty five dollars ($25.00) for each insufficient funds check to pay for additional administrative expenses. The election of a particular remedy shall not constitute a waiver of any other remedy available to the village for collection of the fee. The owner of the household unit, the occupant thereof, and the user of the services shall be jointly and severally liable to pay such collection fee, and the services are furnished to the household unit by the village only on the condition that the owner of the household unit, occupant thereof, and user of the garbage and refuse service are jointly and severally liable. The village, through its contractor, shall provide municipal waste collection service to the household unit at least once each week and collection of recyclable wastes that have been separated from garbage or refuse on a biweekly schedule.
