4-2-1: DEFINITIONS:
The following words, terms, and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
AGENT: Any person who shall have the responsibility for the care, control, or maintenance of any property for an owner.
ASHES: Residue from fires used for cooking and for heating buildings.
BANNED WASTE: All waste for which disposal by means of landfilling is now or hereafter prohibited by local, state, or federal law, rule, or regulation.
CONSTRUCTION DEBRIS OR DEMOLITION DEBRIS: Any solid waste containing a variety of materials resulting from the construction, demolition, remodeling, or renovation of residential, commercial, or industrial structures. The term also includes cement, concrete, asphalt, or masonry debris resulting primarily from street, sidewalk, bridge, sewer, and water construction, repair, or replacement, which is defined as "clean fill" by the Illinois environmental protection agency.
DUMPSTER: A metal container of one cubic yard or more in volume, with an attached lid, designed for handling by mechanical means.
EXPLOSIVE WASTE: Waste containing any substance or chemical which has a tendency to explode or cause an explosion.
GARBAGE: Includes and means waste resulting from the handling, processing, preparation, cooking, and consumption of food and wastes from the handling, processing, storage and sale of produce.
HAZARDOUS HOSPITAL WASTE: As defined in the Illinois environmental protection act, 415 Illinois Compiled Statutes 5/1 et seq., as amended, or in rules promulgated thereunder.
HAZARDOUS WASTE: As defined in the Illinois environmental protection act, 415 Illinois Compiled Statutes 5/1 et seq., as amended, or in rules promulgated thereunder.
HIGHLY FLAMMABLE WASTE: Waste containing any substance or chemical which has a propensity to ignite greater than that which is customary for municipal waste.
HOUSEHOLD UNIT: Single-family dwellings including house trailers and each unit of a multiple-family dwelling consisting of two (2), three (3), or four (4) dwellings. A household unit does not include any other entity including, without limitation, commercial or retail establishments, industrial facilities, or public buildings.
LANDSCAPE WASTE: Grass, shrubbery, cuttings, leaves, tree limbs, and other materials accumulated as the result of the care of lawns, shrubbery, vines, and trees.
MUNICIPAL WASTE: Any garbage, refuse, ashes, rubbish, debris, general household waste, and recyclable waste. Municipal waste does not include any white goods, landscape waste, banned waste, construction or demolition debris, explosive waste, hazardous waste, hazardous hospital waste, highly flammable waste, potentially infectious medical waste, radioactive waste, regulated medical waste, special waste, or tires.
POTENTIALLY INFECTIOUS MEDICAL WASTE: As defined in the Illinois environmental protection act, 415 Illinois Compiled Statutes 5/1 et seq., as amended, or in rules promulgated thereunder.
PUBLIC PLACE OR PUBLIC WAY: Any and all streets, sidewalks, boulevards, alleys, public grounds, or public buildings.
RADIOACTIVE WASTE: Waste containing any substance or chemical which emits radioactive particles.
RATPROOF: A form of construction which would prevent the entrance and exit of rats, mice, and other rodents.
RECYCLABLE WASTE: A. Means and includes:
      1.   Newspaper, magazines, including any shiny surface paper, softback books, and phone books;
      2.   Office, computer, notebooks, and gift wrap paper (with any clips, spirals, or binders removed);
      3.   Brown kraft paper (e.g., paper grocery bags);
      4.   Unwaxed cardboard;
      5.   Shipboard/chipboard and carrier stock (very thin cardboard), including, e.g., boxes for cereal, soft drinks, gifts, or facial tissues;
      6.   Aluminum cans, foil and pans, which must be clean;
      7.   Steel or tin cans;
      8.   Glass containers or jars (clear, brown, or green), but not window glass, dinnerware or ceramics;
      9.   Plastic buckets (up to 5 gallons) and plastic containers #1 through #5 and #7, i.e., if a container is stamped with any #1 through #5 and #7 inside a triangle, it is acceptable;
      10.   Junk mail and envelopes (with any plastic cards, stick on labels or unused stamps removed); and
      11.   Paperback books, but not hardcover books.
Containers from subsections 6 through 9 of this definition must be emptied and rinsed clean to be considered recyclable waste.
   B.   Recyclable waste does not include:
      1.   Plastic #6 styrofoam, expanded foam, or clear polystyrene;
      2.   Plastic bags;
      3.   Plastic film, including tarps, wraps, sheets, etc.; or
      4.   Motor oil, insecticide, herbicide, or hazardous chemical containers.
REFUSE: Combustible trash including, but not limited to, paper, cartons, boxes, barrels, wood, excelsior, wood furniture, and bedding; and noncombustible trash including, but not limited to, metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, and other mineral waste; and street rubbish including, but not limited to, street sweepings, catch basin dirt, and contents of litter receptacles, but not including white goods as defined in the Illinois environmental protection act, 415 Illinois Compiled Statutes 5/1 et seq., as amended, or in rules promulgated thereunder.
REGULATED MEDICAL WASTE: As defined in 40 CFR section 259.30.
RIGHT OF WAY: Public property dedicated for a public purpose such as vehicular traffic.
ROADWAY: That portion of a highway improved, designed, or ordinarily used for vehicular traffic.
SPECIAL WASTE: As defined in the Illinois environmental protection act, 415 Illinois Compiled Statutes 5/1 et seq., as amended, or in rules promulgated thereunder.
TIRE: A hollow ring made of rubber or similar materials which was manufactured for the purpose of being placed on the wheel rim of a vehicle.
WASTE: Any garbage, refuse, ashes, rubbish, debris, general household waste, white goods, banned waste, construction or demolition debris, explosive waste, hazardous waste, hazardous hospital waste, highly flammable waste, landscape waste, potentially infectious medical waste, radioactive waste, regulated medical waste, special waste, and tire.
WHITE GOODS: As defined in the Illinois environmental protection act, 415 Illinois Compiled Statutes 5/1 et seq., as amended, or in rules promulgated thereunder. (Ord. 653, 3-11-2010)
