4-1-3: ENUMERATION OF NUISANCES; ENUMERATION NOT EXCLUSIVE:
   A.   It is hereby declared to be a nuisance and a danger to the health, safety, welfare, peace and comfort of the village and its residents for any person or owner to: (Ord. 695, 3-22-2012)
      1.   Animals:
         a.   Keep or maintain any animals in an unclean or filthy manner or in unclean or filthy surroundings, or to keep or maintain any animals, animal matter or animal carcasses from which emit any particularly putrid, foul or offensive odors. (Ord. 695, 3-22-2012; amd. 2012 Code)
         b.   Keep or harbor any animal which disturbs the peace by loud noises at any time, day or night, or permit any animal to make such noises. (2012 Code)
         c.   For the owner or possessor of any animal to permit the animal to walk or defecate upon private property without the consent of the occupant thereof.
         d.   For the owner or possessor of any animal to permit such animal to damage or destroy any personal property of another person.
         e.   For the owner or possessor of any dog to permit said dog to run at large.
         f.   For the owner or possessor of any animal to fail to promptly remove any deposit of such animal's waste wherever it may exist in the village.
      2.   Animal Houses: Locate or maintain, or permit to exist or remain anywhere within the village, any stable, pigsty, or coop for chickens, ducks, geese, or other fowl.
      3.   Offensive Odors: Conduct any business or use any premises so as to create an offensive or foul odor which taints the air and renders it nauseous to persons in the vicinity.
      4.   Cellars, Vaults And Privies: Cause or permit any cellar, vault, cistern, drain, privy, yard or other premises whatsoever to become putrid, foul or offensive or injurious to the public health.
      5.   Stagnant Water: Cause or permit to be collected or to stand upon any property any foul or stagnant water of any kind.
      6.   Foul Or Noxious Substances: Use, deposit or keep any property, substance or thing emitting or causing any foul, offensive, noisome, nauseous or noxious odor, effluvia or stench particularly repulsive to the physical senses and which annoys, discomforts or endangers the welfare, health or safety of any person.
      7.   Refuse, Rubbish, Garbage And Debris: Deposit, accumulate or cause the existence of any refuse, rubbish, garbage, debris, bulky or yard wastes or other materials on any property.
      8.   Petroleum Products: Accumulate or store any petroleum, naphtha, benzine, coal oil, gasoline, kerosene, turpentine or other petroleum products or inflammable fluids of any kind, in quantities greater than ten (10) gallons, on the interior of or within fifty feet (50') of any building exclusively occupied as a residence; provided, however, that this subsection A8 shall not apply to licensed gasoline service stations or to fuel used for heating the nearest adjacent residence.
      9.   Explosives: Deposit, accumulate, store or present, within three hundred feet (300') of any building occupied as a residence or business, any powder magazine, nitroglycerine, dynamite or other explosive substance of any kind. (Ord. 695, 3-22-2012)
      10.   Abandoned Appliances: Cause or permit the existence or storage in any place accessible to children of any abandoned or discarded refrigerator, icebox, ice chest, deep freeze or other airtight appliance or container of any kind, of a capacity of one and one-half (11/2) cubic feet or more, from which the lids, doors or other covers have not been removed.       11.   Unsafe Or Dilapidated Buildings: Cause or permit the existence of any unsafe or dilapidated building or otherwise cause or permit an insecure building, wall, stack, chimney, cornice, sign, awning or other like structure of any kind which, from manner of construction, age, condition or other circumstances, is or may become a menace to the health, welfare, or safety of persons or property.
      12.   Dust, Cinders And Dirt: Cause or permit any dirt, sand, gravel, cinders, ashes, earth or other similar materials to be hauled, moved, rolled, compacted, scraped, dragged or otherwise disturbed, including, but not limited to, causing or permitting such materials to be disturbed through the operation of a motor vehicle, so as to cause or permit dust to be raised, blown or stirred through the operation of machinery or otherwise, to the detriment of any person or property.
   B.   Nuisances enumerated in this section shall not be deemed exclusive, but are in addition to and to be construed in conjunction with any other nuisances enumerated in statutes or other provisions of ordinances of the village. (Ord. 695, 3-22-2012)
