3-1-3: PERSONS SUBJECT TO LICENSE:
Whenever in this code a license is required for the maintenance, operation or conduct of any business or establishment or for doing business or engaging in any activity or occupation, any person or corporation shall be subject to the requirement if, by himself or through an agent, employee or partner, he holds himself forth as being engaged in the business or occupation; or solicits patronage therefor, actively or passively; or performs or attempts to perform any part of such business or occupation in the village. 3-1-4: FORMS:
Forms for all licenses, and applications therefor, shall be prepared and kept on file by the village clerk. (2012 Code)
3-1-5: SIGNATURES:
Each license issued shall bear the signatures of the village president and the village clerk in the absence of any provision to the contrary. (2012 Code)
3-1-6: INSPECTION OR INVESTIGATION:
Upon the receipt of an application for a license where laws of the village necessitate an inspection or investigation before the issuance of such license, the village clerk shall refer such application to the proper officer for making such investigation within forty eight (48) hours of the time of such receipt. The officer charged with the duty of making the investigation or inspection shall make a report thereon, favorable or otherwise, within ten (10) days after receiving the application or a copy thereof. 3-1-7: TERM OF LICENSE:
All annual licenses shall terminate on the last day of the fiscal year of the village, where no provision to the contrary is made. (2012 Code)
3-1-8: BUILDING AND PREMISES:
No license shall be issued for the conduct of any business and no license shall be issued for any thing or act if the premises and building to be used for the purpose do not fully comply with the requirements of the village. (2012 Code)
3-1-9: CHANGE OF LOCATION:
In the absence of any provision to the contrary, the location of any licensed business or occupation or of any permitted act may be changed, provided ten (10) days' notice thereof is given to the village clerk. (2012 Code)
3-1-10: NUISANCE BUSINESSES PROHIBITED:
No business, licensed or not, shall be conducted or operated as to amount to a nuisance in fact. (2012 Code)
3-1-11: POSTING LICENSE:
It shall be the duty of any person conducting a licensed business in the village to keep his license posted at all times in a prominent place on the premises used for such business. (2012 Code)
3-1-12: REVOCATION OR SUSPENSION OF LICENSE:
   A.   Authority; No Refund Of Fee: Any license may be revoked, or suspended for a limited time, by the president at any time during the duration of such license for any violation by the licensee or his agent of any provision of this code relating to such license, including the failure to secure the same or the intentional misrepresentation as to any material fact upon the application therefor, or to the premises occupied or used, or of any state or federal law relating thereto; and such revocation or suspension may be in addition to any monetary fine imposed. In case of revocation or suspension of any license, no part of any license fee shall be refunded by the village.
   B.   Notice Required; Hearing; Board Decision:
      1.   Unless any provision of this code provides to the contrary, no revocation or suspension of any license issued hereunder shall be deemed effective until notice thereof has been served personally upon or mailed to the named licensee at the address specified in the application for the said license.
      2.   If, within five (5) days of the date of notice of the revocation or suspension of any license, the named licensee submits to the village clerk in writing a request for a hearing concerning such revocation or suspension, said revocation or suspension shall be suspended until such time as the village board shall grant the licensee a special hearing.
      3.   If the village board, after such hearing, affirms the revocation or suspension of said license, the same shall become immediately effective; if the village board, by a majority vote, overrules the revocation or suspension, the same shall be deemed null and void.
   C.   Grounds For Revocation: Business licenses issued under this code, unless otherwise provided, may be revoked by the village president and board of trustees after notice and hearing as provided in subsection B of this section for any of the following causes:
      1.   Any fraud, misrepresentation or false statement contained in the application for the license.
      2.   Any violation by the licensee of this code or state law relating to the license, the subject matter of the license, or the premises occupied.
      3.   Conviction of the licensee of any felony or of a misdemeanor involving moral turpitude.
      4.   Failure of the licensee to pay any fine or penalty owing to the village.
      5.   Refusal to permit an inspection or investigation or any interference with a duly authorized village officer or employee while in the performance of his duties in making such inspection, as provided in this code. (2012 Code)
