Skateboards, Roller and Street Skates, Scooters, Pedal Cycles
377.01   Scope.

377.01 SCOPE.
   The use of skateboards, roller skates, street skates, scooters, pedal cycles and other types of devices propelled by human or non-human power within the Village shall be regulated as outlined in this chapter.

377.02 WORD USAGE AND DEFINITIONS.
   (a)   Word Usage. In the interpretation of this chapter, the singular shall include the plural, and the masculine shall include the feminine and the neuter.
   (b)   Exemptions. Baby strollers, wheelchairs or other nonrecreational human-powered devices shall be exempted from the provisions of this chapter.
   (c)   Definitions.
      (1)   “Council” means the Council of the Village of Genoa.
      (2)   “Genoa” means the Village of Genoa, Ottawa County, Ohio.
      (3)   “Pedal Cycle” means a device propelled solely by human-powered pedals.
      (4)   “Roller Skate” or Street Skate” means a device having multiple sets of wheels affixed to shoes or boots and used to glide over hard surfaces by an individual.
      (5)   “Scooter” means a vehicle consisting of a narrow board mounted on two wheels in tandem and guided by a handle attached to the front wheel. The person stands with one foot on the board and pushes the device with the other foot, or the vehicle is powered by means other than human power.
      (6)   “Sidewalk” means the portion of a street between the curb lines or the lateral lines of a roadway and the adjacent property lines intended for use by pedestrians.
      (7)   “Skateboard” means a device consisting of a flat surface constructed of wood, metal, plastic, fiberglass, or similar material with two or more wheels affixed to the underside and which is used by a person for coasting and guided by the distribution of the weight of the user.
      (8)   “Street or Traffic Way” means the entire width between the boundary lines of every publicly maintained way when any part thereof is open to the use of the public for vehicular travel.

377.03 PROHIBITED ACTS.
   No person shall do any of the following within the Village of Genoa:
   (a)   Ride a skateboard, roller skates, street skates, scooter, pedal cycles, or any human or non-human powered vehicle device on any public sidewalk located within the following prescribed areas:
      (1)   Main Street from Fifth Street to Eighth Street;
      (2)   The North side of Sixth Street from Main Street to Washington Street;
      (3)   The North side of South Railroad Street from Main Street to the North South alley between Main Street and West Street;
      (4)   The South side of Eighth Street from Washington Street to the North South alley between Main Street and West Street;
      (5)   In areas where signs prohibit riding such vehicles;
      (6)   The walkway in the parking lot on South Railroad Street from Sixth Street to West Street.
   (b)   Erect, construct, or place any type of ramp designed for use with skateboards, roller skates, street skates, scooters, pedal cycles, or any human or non-human powered device onto the streets, alleys, sidewalks, and traffic ways in the Village of Genoa, or on any property owned, leased, managed or under control of the Village of Genoa, except in areas provided for such purposes.
   (c)   Ride a bicycle, skateboard or use roller skates, street skates, scooters, pedal cycles, or any human or non-human powered device on any sidewalk located within the jurisdictional limits of the Village of Genoa in a reckless manner. No person shall ride a bicycle, skateboard, roller skates, street skates, scooters, pedal cycles, or any other human-powered device on the sidewalk without exercising due care for the safety of other persons using the sidewalk, and said person shall always give way to pedestrian traffic. It shall be unlawful for any person to leave a skateboard, roller skates, street skates, scooter, pedal cycle, or any other human-powered device upon a sidewalk in such a manner as to obstruct pedestrian traffic.
   (d)   Ride a skateboard, roller skates, street skates, scooters, pedal cycles, or any human or other powered device on any street, alley or sidewalk located within the jurisdictional limits of the Village of Genoa in violation of any traffic laws found in Part Three - Traffic Code of the Codified Ordinance of Genoa.
   (e)   Ride a skateboard, roller skates, street skates, scooters, pedal cycles, or any human or other powered device on any street or alley in such a manner as to impede or block the normal and reasonable movement of traffic.
