(a) The City provides Worker's Compensation insurance covering accidents, injuries and illnesses deemed to be caused by work or determined to be work related. Worker's Compensation insurance covers all costs for medical treatment, partial payment to the employee for lost wages after a three-day waiting period, and compensation for any resulting permanent partial or total disability.
(b) The employee is required to notify the supervisor as soon as possible after any accident, injury or illness and to seek treatment immediately from the City's designated medical providers. The Worker's Compensation Administrator is the final authority in determining eligibility of coverage. The amount of coverage is based on a percentage of your average weekly wage subject to a maximum benefit.
(c) Worker's Compensation benefits may be reduced by twenty-five percent to fifty percent if the injury is determined to be caused by the employee's own failure to follow safety rules or failure to use proper safety devices. Benefits for injuries in connection with alcohol or non-prescribed controlled drugs will be reduced by fifty percent or may be forfeited.
(d) During any period of leave due to injury, the employee is prohibited from working at any other job or in self-employment and is prohibited from engaging in any activity which presents a risk of aggravating the injury or slowing the healing process.
(e) The City normally subsidizes the partial wage payment provided by Worker's Compensation and provides paid leave during the three-day waiting period, resulting in full pay from the date of injury. If approved, the employee may receive full pay for up to one year from date of injury. Eligibility and extent of this benefit will be determined by the City Administrator. If approved, the employee will remain on regular pay status for the first three days. On the fourth day of Worker's Compensation, the employee's pay will be reduced by the amount payable from the Worker's Compensation provider. The City will continue to monitor payments made by the Worker's Compensation provider and make adjustments to the employee's partial pay. At no time will the total rate of pay exceed the employee's regular rate of pay.
(f) Employees who are injured due to their own negligence or carelessness, as determined by the City's, may not receive injury benefit beyond that provided by Worker's Compensation.
