(a) Where the remains of the deceased are claimed without controversy or conflict by any relative, significant other or interested party for internment or cremation at such person's own expense, the body shall immediately be relinquished to such person if no longer needed for investigative purposes by the Police Department or the County Coroner's Office.
(b) Where a controversy exists as to the rights to the remains of the deceased, the remains shall be released only upon a judicial order specifying the party to whom the remains shall be legally released.
