1020.13  BACKFILLING; PAVEMENT REPLACEMENT; RESTORATION; DURATION.
   (a)   Each person who, under authority of this chapter, opens or causes to be opened any street, alley, public place or dedicated right of way in the City shall cause such street, alley, public place or dedicated right of way, immediately upon the completion of such work or before leaving the same, to be backfilled in accordance with City of Geneva standards.
   (b)   The excavation shall be backfilled with material acceptable to the inspector and shall be installed in accordance with City of Geneva standards. The backfill material shall be compacted in six-inch layers using mechanical compactors, if necessary, to obtain required compaction. The excavation shall be brought to the existing street grade. If an alternative material is permitted to be used by the inspector in lieu of the standard material, the alternative material shall be removed and replaced with the standard material within fourteen days of the date of opening. The excavation below such pavement cut shall converge toward the bottom so that the width at the bottom is less than the width at the surface of the pavement. If the sides of the opening cave in during the excavation, and such an opening is in a paved street, the pavement shall be removed to conform to the size of the caved-in area, plus twelve inches.
   (c)   Portland cement concrete and asphaltic concrete pavements shall be saw-cut perpendicular to the street grade along straight uniform planes. Adjacent pavement damaged by equipment or construction shall be included to the extent necessary to provide a solid undamaged pavement for the patch to meet. Excavations in an unpaved street or alley shall have a topping of not less than twelve inches of gravel. Excavations in a street or alley paved with asphalt shall have a topping of not less than three inches of No. 404 asphalt. Excavations in a street paved with concrete shall have a top thickness of not less than ten inches of ODOT specification Class C (No. 4000 psi) concrete.
   (d)   All excavations within the right of way shall be clearly marked and reported to the City for inspection prior to the commencement of any work. The Street Department Superintendent shall be provided a copy of all permits for work being done within the right of ways. Accurate records of all excavations and street openings shall be kept by the Superintendent for a period of twelve months to insure that each excavation and street opening remains in place and does not require any maintenance. If maintenance is required by the City or its contractor during the twelve-month period, the permit holder shall reimburse the City for the actual cost of repair and maintenance, plus fifteen percent for administrative costs.
   (e)   Persons having authority, by permit, to excavate in a street, alley, public place or dedicated right of way shall cause such excavations to be performed, filled and permanently covered over within fourteen days after making the opening. Upon failure to do so, the same may be done by the City at the expense of such permit holder and the City Manager may refuse to issue further permits to such permit holder, until such costs are fully paid.
   (f)   During the progress of the work, at least one-half of the street, alley or public place shall be kept open and free for the passage of vehicles, and such excavation shall be properly sheeted and carefully guarded in accordance with Section 661.09 of these Codified Ordinances and properly lighted at night in such a manner so as to prevent accidents.
   (g)   No tunneling shall be allowed, except by order or consent of the City Manager.
   (h)   No sidewalk, pavement or treelawn shall be disturbed, or any trench opened in a street, alley, public place or right of way, before the applicant is fully prepared to lay pipe or conduit, or make the necessary repairs therein, and no such excavation or trench shall be left open for a greater period of time than may be necessary to perform the work contemplated.
   (i)   The permit holder and/or the person making an excavation, or causing the same to be made, shall be liable for all damages to persons or property which may in any way result therefrom.
   (j)   Forty-eight hours prior to any excavation or street opening which is to be permanently patched, the applicant or contractor doing the work will provide the Street Department Superintendent with a list of all excavations or openings which are scheduled to be completed.
   (k)   A sidewalk, driveway, seeded treelawn, tree, shrub, street or safety sign or guardrail, located within a public right of way, which is removed or destroyed during an excavation, shall be replaced or restored to its original condition or better by the permit holder. When it is necessary to open any street, the sides of the pavement cut shall come as near as practical to perpendicular to the street surface.
