(a) The City declares that it has a responsibility to its residents to take all appropriate measures in order to ensure that no portion of the City is threatened or faced with a disruption, interruption or discontinuance of cable service because of the actions of any cable operator or cable franchisee, or the actions of the City itself.
(b) In addition to the principles and ideals enumerated in subsection (a), the City also expresses that its intent covers the following:
(1) Providing for continuity of services in the event of Municipal acquisition of a cable system within the City;
(2) Providing for continuity of services in the event of a proposed abandonment, withdrawal or cessation of cable service by a cable operator or cable franchisee;
(3) Providing for continuity of services in the event of the revocation, termination or nonrenewal of a cable franchise;
(4) Providing for continuity of services in the event of an expiration of a franchise;
(5) Preventing disruption of cable service which would provide a hardship on those residents of the City who rely on cable services, including the emergency alert override, as their primary or secondary source for information;
(6) Assuring cooperation and accountability of a cable operator or franchisee with respect to the continuous and uniterrupted provision of cable services during the period of time such operator or franchisee serves residents of the City;
(7) Providing for the health, safety and welfare of the residents of the City by ensuring the continuous and uninterrupted provision of cable services and by establishing interim or transitional procedures for a cable operator or franchisee to abide by in the event of:
A. Municipal acquisition of a cable system within the City;
B. The abandonment, withdrawal or cessation of cable service by a cable operator or franchisee;
C. The revocation, cancellation or nonrenewal of a cable franchise; or
D. The expiration of a franchise;
(8) Preventing the interruption or cessation of cable services which would disrupt or eliminate the diversity of programming choices enjoyed by subscribers of cable television, and thereby restricting their ability to receive information; and
(9) Providing a benefit to any cable operator or franchisee in that such an operator or franchisee would have an orderly transition process to transfer the operation, construction and maintenance of a cable system from one cable operator to another operator or person, thereby reducing the likelihood of any administrative or judicial action being taken.
