777.08 ACTION ON PLAN; PERMIT ISSUANCE; SITE INSPECTION; UNAUTHORIZED CUTTING.
   (a)   Within thirty (30) days of submittal of a complete application for a Commercial Tree Cutting Permit, the Building Official may forward the application to the ODNR and/or any other public agencies for review and recommendation of whether the application should be approved, approved with conditions, or disapproved. After ODNR or other public agencies make a recommendation as to the application, the Building Official shall instruct the applicant to prepare a timber sale prospectus and any other documents necessary to assist the Building Official in determining whether tree cutting will be performed in a manner consistent with this chapter. The Building Official may forward the timber sale prospectus and all other documents to ODNR and/or other public agencies for additional review and recommendation of whether the application should be approved, approved with conditions, or disapproved. After the Building Official reviews the timber sale prospectus and other requested documents, the Building Official shall approve, approve with modifications, or disapprove the application in writing to the applicant. If the application is disapproved, the Building Official shall state the reason(s) for disapproval in writing to the applicant. If the application is approved with or without conditions and the applicant does not appeal the conditions as provided for in Section 777.11, the Building Official shall forthwith issue the Permit reflecting the approval with or without conditions as the case may be.
   (b)   Each unauthorized cutting of an unmarked tree shall constitute a separate violation of this chapter which will subject both the property owner and the licensed contractor to all penalties provided for in this chapter. Any unauthorized tree cutting shall also constitute grounds for the immediate revocation of the Commercial Tree Cutting Permit and the contractor's license.
