Any applicant for a Commercial Tree Cutting Permit aggrieved by the Building Official's interpretation of any of the provisions of this chapter or by a final written decision on the application for a Commercial Tree Cutting Permit by the Building Official may appeal to the Village Planning and Zoning Commission. Such appeal shall be taken within twenty (20) days after the date of the written decision or interpretation by filing with the Building Official a notice of appeal specifying the grounds therefor. The Building Official shall forthwith transmit to the Planning and Zoning Commission all papers constituting the record upon which the action being appealed was taken. The Planning and Zoning Commission may reverse or modify the decision being appealed only on the grounds of a hardship of a practical and severe economic nature shown by the appellant and only if the appellant shows that the Commission's decision to reverse or modify the Building Official's decision will not adversely affect the public health, safety, or general welfare, will encourage healthy forestland growth, and will not negatively impact the environment.
