1313.072 PROCEDURE FOR ESTABLISHING HISTORIC PROPERTY OR HISTORIC LANDMARKS.
   To consider the establishment of a historic property or landmark, the following procedure shall be followed:
   (a)   The initiation of a proposal for a historic property or landmark shall be made only by the property owner(s) in legal title. The property owner(s) of the proposed historic request shall present to the Board a petition expressing a desire to have the property or landmark included within the historic district, which shall specify the characteristics of the property or landmark that uniquely define it as historic. The boundaries of the proposal shall be specified. The petition shall be signed by the owner(s) and shall include verification of such requirements with reference to the Cuyahoga County Fiscal Officer's property records.
   (b)   The Board shall refer the petition to the Historic District Subcommittee which shall consider the proposal in terms of the criteria provided in Section 1313.071. After review, the Historic District Subcommittee shall forward the proposal with its recommendation along with the written comments of the owner(s) to the Board which shall forward the same to the Planning Commission.
   (c)   The applicant(s) requesting the property or landmark designation shall apply to the Planning Commission and pay all applicable fees. The proposal shall be placed on the agenda for the next regularly scheduled Planning Commission meeting. The Planning Commission shall hold a public meeting on a proposal for historic designation. Public notice shall be posted no less than 24 hours prior to meeting.
   (d)   The Planning Commission shall recommend one of the following to Council:
      (1)   That the proposal be approved as requested;
      (2)   That the proposal be approved as modified by the Planning Commission; or
      (3)   That the proposal be denied.
   (e)   Upon receipt of the Planning Commission's recommendation, the Council shall cause an appropriate ordinance to be prepared stating the reason for the designation of a historic landmark or the establishment of a historic property. The ordinance shall be placed on the agenda for the next regularly scheduled Council meeting.
   (f)   Council shall give due consideration to the findings and recommendations of the Historic District Subcommittee, the Board, and the Planning Commission and to any public comments and shall make a final determination. Council shall:
      (1)   Approve the proposal as requested or as modified by the Planning Commission and designate the property as a landmark or as an historic property.
      (2)   Deny the proposal.
   (g)   After a decision by Council, the Clerk of Council shall notify all persons known to have legal or equitable interest in said property. The Planning Commission and Board shall also be notified.
   (h)   The Clerk of Council shall notify any appropriate County, State or Federal offices after a designation is approved. The Clerk of Council shall cause to be recorded in the office of the Cuyahoga County Fiscal Officer a copy of each ordinance designating a historic property or landmark.
   (i)   No legislation under this section shall be rendered invalid by any failure or alleged failure to provide a prescribed notice by mail or otherwise by person.
   (j)   Designation of a historic property or landmark shall be considered a zoning district overlay with the regulations of the underlying zoning district remaining in effect for any property designated as a landmark or included in the historic district.
   (k)   Following the designation of the landmark or historic property, the Board may place or cause to be placed on such landmark an official Village plaque, indicating that such property or part thereof has been designated a landmark in the Village. In the case of an area designation, the Board may place or cause to be placed official village plaques at appropriate location(s) near all entranceways to the new district. These official plaques shall remain the property of the Village.
