(A) Smoking, as defined in I.C. 7.1-5-12-3, and the use of electronic cigarettes (e-cigarettes, e-cigs, and electronic water pipes), vaporizers, and vapor products are prohibited in the following locations:
(1) An enclosed area of a structure in which the public is invited or permitted (public place), including, but not limited to:
(a) Aquariums, galleries, libraries, and museums;
(b) Banks, laundromats, professional offices, and retail establishments;
(c) Bingo facilities;
(d) Child care and adult day care facilities;
(e) Convention facilities;
(f) Public and private education facilities;
(g) Elevators;
(h) Gaming facilities;
(i) Healthcare facilities;
(j) Hotels and motels;
(k) Common areas in apartment buildings, condominiums, trailer parks, retirement facilities, nursing homes, and other multiple-unit residential facilities;
(l) Polling places;
(m) Public transportation vehicles and related facilities;
(n) Restaurants;
(o) Shopping malls;
(p) Shopping malls;
(q) Motion picture and live performance theatres;
(r) Bars, except as provided in § 111.16(A);
(s) All restrooms, lobbies, reception areas, hallways, and other common-use areas of such structures and facilities; and
(t) Schools.
(2) A place of employment;
(3) Outdoor dining areas within the public-right-of way; outdoor seating areas of restaurants, bars, and businesses, except benches and those seating areas restricted to individuals over the age of 18; and areas that are within eight feet of where smoking is prohibited; and
(4) The area within eight feet of a public entrance to:
(a) A public place; or
(b) A place of employment.
(B) Prohibits the possession of tobacco, electronic cigarettes (e-cigarettes, e-cigs, and electronic water pipes), vaporizers, and vapor products on his or her person by anyone under the age of 21.
