(A) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
SNOW REMOVAL EMERGENCY. There shall be a SNOW REMOVAL EMERGENCY whenever there is a snow accumulation on the public streets of the city of two inches or more, and provisions of this division in regard to parking on public streets during snow removal operations shall be effective and will be enforced.
STREET. The entire width of any public roadway within the city; and it shall not be limited to those roadways designated as a “Street” but include “Avenues” and all other names by which public roadways are designated, but shall not include alleys or alleyways.
(B) Prohibited parking on streets. In the event of a snow removal emergency, as defined by division (A) above, no person shall park, or allow to remain parked, any motor vehicle or trailer on any public street until such time as the street has been cleared of snow.
(C) Restricted parking in alleys. In the event of a snow removal emergency, as defined by division (A) above, parking in alleys shall be permitted; provided, however, no person shall park, or allow to remain parked, any motor vehicle or trailer on any public alley so as to obstruct emergency through traffic.
(D) Towing in the downtown area. Any vehicle parked in the downtown area between Fifth Street and Second Street and/or between Depot Avenue and Center Avenue will be immediately ticketed and towed in the event of snow emergency, as defined by division (A) above.
(E) Immunity of liability in event of violation. The city shall not be the responsible party for providing alternate parking space during a snow removal emergency, and neither the city, nor its agents, nor it employees will be liable for damage to any person, motor vehicle, or trailer damaged by snow removal operations when such motor vehicle or trailer damaged by snow removal operations is in violation of divisions (A) through (C) above.
(F) No authorization for otherwise prohibited or restricted parking. Nothing in divisions (A) through (D) above authorizes parking of a vehicle where otherwise prohibited or restricted, by signs or otherwise.
