§ 15.15.125  ZONING DISTRICT MAP AND BOUNDARIES OF DISTRICTS.
   (A)   Zoning district map.
      (1)   The Zoning Districts and their respective boundaries as shown upon the Zoning District Map of the Village of Gardner as may be amended from time to time, including all legends, notations, references or other information shown thereon, are hereby adopted and incorporated into and made a part of this chapter with the same force and effect as if fully set forth herein.
      (2)   The original zoning district map, properly attested to, shall be filed with the Village Clerk.
   (B)   Boundaries of districts.  Where uncertainty exists with respect to the boundaries of the various zoning districts as shown on the zoning district map, the following rules apply.
      (1)   District boundary lines are either:
         (a)   The center lines of railroads, highways, streets, alleys, easements or waterways;
         (b)   The boundary lines of sections, quarter sections and divisions of sections;
         (c)   Property lines of record on the effective date of this chapter for tracts and lots; or
         (d)   The lines extended unless otherwise indicated.
      (2)   Wherever a district is indicated as a strip adjacent to and paralleling a street or highway, and the boundaries are not located as set forth in division (B)(1)(a) above, the depth of the strips shall be in accordance with the dimensions shown on the map measured at right angles from the center lines of the street or highway, and the length of frontage shall be in accordance with dimensions shown on the map from section, quarter section or division lines, or center lines, of streets, highways or railroad rights-of- way unless otherwise indicated.
      (3)   Wherever a district boundary line divides a lot in single ownership, the regulations for either portion of the lot may, in the owner’s discretion, extend to the entire lot, but not more than 40 feet beyond the boundary line of the district.
      (4)   Questions concerning the exact locations of zoning district boundary lines shall be resolved by the Village Council after receiving recommendations for the Village of Gardner Planning and Zoning Board and the Village Council.
