For the purpose of this chapter, the following definitions shall apply unless the context indicates or requires a different meaning.
ADULT BOOK STORE. An establishment having as a substantial or significant proportion of its stock in trade books, magazines and other periodicals which are distinguished or characterized by their emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas.
ADULT CABARET. A nightclub, bar, theater, restaurant or similar establishment which frequently features live performances by topless and/or bottomless dancers, go-go dancers, exotic dancers, strippers or similar entertainers, where the performances are distinguished or characterized by an emphasis on specified sexual activities or by exposure of specified anatomical areas and/or which regularly feature films, motion pictures, video cassettes, slides or other photographic reproductions which are distinguished or characterized by an emphasis upon the depiction or description of specified sexual activities or specified anatomical areas for observation by patrons.
ADULT THEATER. An establishment which presents the viewing of motion pictures, films, theatrical productions, video cassettes, slides and other forms of visual productions, for any form of consideration, in which a preponderance of the total presentation time is devoted to showing materials which are distinguished or characterized by an emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas for observation by patrons therein. ADULT THEATER FACILITIES may include but is not limited to open lots for viewing from a motor vehicle or outdoor seating area; an enclosed building with private viewing areas for five or fewer people or an enclosed building with viewing areas for more than five people.
ADULT USE. A use which involves either wholly or partially an activity distinguished or characterized by its emphasis on matters depicting, describing or relating to specified sexual activities or specified anatomical areas, including but not limited to, the operation of adult bookstores, adult cabarets and adult video stores.
ADULT VIDEO STORE. An establishment having as a substantial or significant proportion of its stock in trade video cassettes and similar materials which are distinguished or characterized by their emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas.
SPECIFIED ANATOMICAL AREAS. For the purpose of this section, SPECIFIED ANATOMICAL AREAS is defined as:
(1) Less than completely or opaquely covered:
(a) Human genitals;
(b) Pubic region;
(c) Buttock; and
(d) Female breasts below a point immediately above the top of the areola.
(2) Human male genitals in a discernible turgid state, even if completely or opaquely covered.
SPECIFIED SEXUAL ACTIVITIES. For the purpose of this section SPECIFIED SEXUAL ACTIVITIES are defined as:
(1) Human genitals in a state of sexual stimulation or arousal;
(2) Acts of human masturbation, sexual intercourse, fellatio or sodomy; and
(3) Fondling, kissing or other erotic touching or specified anatomical areas.
