(A) All wastewater user charges shall be based upon water consumption as determined by each user's water meters. There is hereby established a minimum monthly charge for wastewater services in the amount of $9 per month. An additional user fee shall be paid for wastewater services as established by the Village Council by ordinance from time to time. The minimum monthly charge and basic user rate for all users located outside the corporate limits of the Village of Gardner shall be quadruple (four times) the rate for persons residing within the corporate limits of the Village of Gardner.
(B) (1) All non-metered residential, commercial or industrial users of the wastewater facilities shall pay a minimum flat rate charge per month as may be determined by the Village Council from time to time.
(2) In the event that a single premises is served by a single meter for several users, each user shall pay their respective proportionate share.
(C) (1) The rates established herein for the sewer services shall automatically increase on the first day of each fiscal year at a rate of 5%, to 105% of the rate from the year immediately preceding the then current year.
(2) At the conclusion of each fiscal year, the Water and Sewer Commissioner shall review the status of the water and sewer rates to determine whether the automatic annual increase should be waived or reduced.
(3) Upon completing his or her analysis, the Water and Sewer Commissioner shall report and recommend to the Village Board who may, at its option, waive or reduce the automatic increase for any fiscal year.
(4) Any waiver or reduction of the automatic increase in water and sewer rates by the Village Council shall not constitute a waiver of future rate increases, nor shall the waiver prejudice the future rights of the Village Council in any way.
