§ 5.05.155  WATER SYSTEM CHARGES.
   (A)   (A)   There is hereby established certain charges for water users in Classes A, B, C and D, for water service, based upon water consumed as may be established by the Village Council by ordinance from time to time.
   (B)   The minimum monthly water service charge shall be $11 per month for users inside the corporate limits.
   (C)   The minimum monthly charge and the water system charges for users located outside the corporate limits of the Village of Gardner shall be quadruple (four times) the rate schedule set forth herein.
   (D)   There is hereby established rates for the sale of water for non-potable purposes as follows: $32 per each 1,000 gallons.
   (E)   (1)   The rates for the water service shall automatically increase on the first day of each fiscal year at a rate of 5%, to 105% of the rate for the year immediately preceding the then current year.
      (2)   At the conclusion of each fiscal year, the Water and Sewer Commissioner shall review the status of the water rates to determine whether the automatic annual increase should be waived or reduced.
      (3)   Upon completing his or her analysis, the Water and Sewer Commissioner shall report and recommend to the Village Board who may, at its option, waive or reduce the automatic increase for any fiscal year. Any waiver or reduction of the automatic increase in water rates by the Village Council shall not constitute a waiver of future rate increases, nor shall the waiver prejudice the future rights of the Village Council in any way.
