ARTICLE XII: ORDINANCE INITIATIVE AND REFERENDUM
   An ordinance may be initiated by petition, or a referendum on an ordinance enacted by the Council may be initiated by petition as hereinafter provided.
SECTION 12.01 INITIATIVE.
   The registered electors of the city shall have the power to propose ordinances to the Council. If the Council fails to adopt an ordinance so proposed, without any change in substance, the registered electors shall have the power to adopt or reject it at a city election, provided that such powers shall not extend to the operating or capital budget, appropriation of funds, levy of taxes, salaries of the city non-elected officers and employees, or contrary to this Charter or law.
SECTION 12.02 REFERENDUM.
   The qualified voters of the city shall also have power to require reconsideration by the Council or any adopted ordinance other than an emergency ordinance, if the Council fails to repeal an ordinance so reconsidered, to approve or reject it at a city election, provided that such powers shall not extend to the measures excluded above as to initiated ordinances.
