§ 95.99 PENALTY.

   (A)   Any person violating any of the provisions of § 95.01 shall be fined as follows:

      (1)   First violation in a calendar year: $25;

      (2)   Second violation in a calendar year: $50; and

      (3)   Third violation in a calendar year: $100.

   (B)   In lieu of arrest for the first offense, the violator may be issued a citation by any law enforcement officer. Such citation shall impose upon the violator a penalty which may, at the discretion of the violator, be paid to the Town Clerk-Treasurer’s office within 72 hours in full satisfaction of the assessed penalty.

   (C)   Enforcement of this chapter may be by lawsuit initiated in the name of the town by the Town Attorney or by prosecution under the laws of the state where applicable. In the event it is necessary to file such a lawsuit, the defendant shall pay all reasonable attorney fees to the Town Attorney in the event the town should prevail.
