When the city manager shall determine that a nuisance exists under any provision of this code, he shall notify the person responsible for such nuisance of such nuisance and request such person to immediately abate the nuisance. If within ten (10) days from such notice, the person responsible for such nuisance has not taken reasonable action to abate the nuisance, then the city manager or his representative shall file a complaint against the responsible person in the municipal court, provided, notice is not mandatory, and the city manager or his representative may file a complaint without such notice being given when such is determined to be necessary for the public health, safety and welfare.
