A. For the period beginning on the date a permit is issued and ending on the date the permitted work is accepted, the City may perform a safety review of construction, reconstruction or installation of all small wireless facilities and poles as it deems necessary to ensure compliance with this Chapter and the City Code. All City plans, reviews, inspections, standards, and other rights and actions related to the wireless provider’s improvements are for the City’s sole and exclusive benefit and neither the wireless provider nor any other person may rely on the City’s safety reviews or have any rights related to the reviews. The preceding sentence does not prevent the wireless provider from relying on consents, permits, or approvals the City may grant based on the City’s plans, reviews, and inspections. As a condition of obtaining the permits authorized by this Chapter, the wireless provider grants the City the right to access the wireless provider’s small wireless facilities and poles. Except for emergencies, this right of access is limited to dates and times agreed to by the parties.
B. The City may recover from the applicant the City’s actual costs incurred to perform such safety reviews as the City deems necessary. (Ord. C2021-5, 8-24-2021)
