§ 110.092 REGULATIONS APPLICABLE TO ALL JUNK YARDS.
   (A)   General compliance. All junk yards shall comply with the provisions of this subchapter; all other applicable city ordinances, resolutions, rules and regulations; and all other applicable federal, state and local laws.
   (B)   Hours of operation. It shall be unlawful for any junk dealer to purchase in the course of business and accept delivery of any junk from any person between the hours of 10:00 p.m. and 6:00 a.m. It shall be unlawful for any junk dealer to gather, or cause to be collected or gathered in any way, any junk from a location other than the junk yard between the hours of 6:00 p.m. and 6:00 a.m.; provided, however, that this limitation shall not apply to the operation of a household hazardous waste collection event undertaken by the city or the Illinois Environmental Protection Agency.
   (C)   Operation. All junk yards shall be kept in a neat and orderly condition and shall be operated in a manner that does not create a hazard to the health and welfare of the public.
   (D)   Fences. All junk yards shall be enclosed by either a solid, nontransparent wall or a tight board fence in a neatly painted condition or constructed of treated lumber. The wall or fence shall be no less than six feet in height and shall otherwise comply with the city’s fencing regulations.
   (E)   Licensed premises. No junk yard shall be allowed to operate on any property other than the licensed premises.
   (F)   Entrances and exits. No junk yard shall have more than two entrances and two exits, none of which shall exceed 15 feet in width at the property fine.
   (G)   Purchases from minors. No junk dealer at any junk yard shall purchase any junk, except cans, bottles, rags, newspaper and wastepaper, from any minor without consent of the parent or guardian of the minor, given in the presence of the junk dealer.
   (H)   Lost or stolen goods. Every junk dealer at any junk yard that receives or is in possession of any good, article or thing that may have been lost or stolen shall, upon demand, produce the good, article or thing to any member of the City Police Department for examination. It shall be the duty of every junk dealer at any junk yard to report to the Police Department any good, article or thing that was sold to the junk dealer or which was offered to the junk dealer for purchase, if the junk dealer has reason to believe that the good, article or thing was lost or stolen.
   (I)   Storage conditions. The storage of junk at a junk yard shall be confined to certain, separate areas within the junk yard, none of which areas shall be less than 15 feet from another area or from any lot line or from any other building on the licensed premises. No areas shall exceed a gross volume of 2,500 cubic feet or 20 feet in height. A non-combustible barrier approved in advance by the official shall separate combustible and any actual or potential ignition sources.
   (J)   Ignition sources. No person at any junk yard shall deposit ignition sources into anything other than a covered metal or other covered non-combustible receptacle. Under no circumstance shall ignition sources at any junk yard be deposited into any combustible receptacle or placed within 15 feet of any combustible materials. Any covered metal or other covered non-combustible receptacle at any junk yard shall be placed on a non-combustible floor, on the ground outside of a building or on non-combustible stands at least two feet from any exterior windows or door openings. The junk yard licensee shall conspicuously post signage indicating “No Smoking” and “Caution: Combustible Materials” in locations as required by the official.
   (K)   Welding and cutting operations. Welding and cutting operations and equipment at any junk yard shall comply with all of the provisions of the city’s municipal code including specifically, but without limitation, the Fire Code. Welding and cutting operations and equipment shall only be performed at any junk yard by the junk dealer or any other individual authorized to conduct welding and cutting operations by the junk dealer and by the Fire Code.
   (L)   Weed maintenance and abatement. No weeds or grass at any junk yard shall be allowed to grow in excess of 12 inches. The junk yard licensee shall be responsible for cutting and otherwise maintaining weeds and grass in a neat and orderly condition.
   (M)   Fire lanes. The junk yard licensee shall be responsible for repair, maintenance and signage of the fire lanes depicted on the site plan required by § 110.087(C)(8) and shall keep the fire lanes free and clear at all times for access and use by firefighting and other emergency equipment.
   (N)   Smoking. Smoking or carrying a lighted pipe, cigar or cigarette or any other type of smoking paraphernalia is prohibited within ten feet of any combustible material at any junk yard.
