§ 90.046 VICIOUS DOG.
   (A)   It is hereby declared to be a nuisance, and it shall be unlawful for any person to keep or maintain any dog in the city which has been found to be a vicious dog pursuant to this subchapter or the Animal Control Act. For purposes of this section, the term “vicious dog” shall mean a dog that, without justification, attacks a person and causes serious physical injury or death or any individual dog that has been found to be a “dangerous dog” upon two separate occasions.
   (B)   If the existence of a nuisance is established, the owner of the dog or other animal shall be in violation of this chapter. Furthermore, the court may enter an order restraining the owner from maintaining the nuisance and may order that the dog or other animal be humanely dispatched.
