§ 50.15 GENERALLY.
   (A)   Service provided. The city shall provide by its agents, contractors or employees a solid waste collection and disposal service to persons owning or residing in one-family, two-family or three-family dwellings within the city, in the manner and to the extent provided in this chapter. However, owners of multi-family structures containing four or more dwelling units may elect to use the services provided by the city for the collection and disposal of refuse and pay therefor at the rates established in § 50.40.
   (B)   Service not provided. The city shall not provide a solid waste collection and disposal service to any commercial, manufacturing, industrial, institutional or business enterprise. The service will also not be provided to owners of multi-family structures containing four or more dwelling units who elect to dispose of solid waste through a private solid waste hauler. In these cases, the private arrangements shall comply with any ordinance and city regulations governing solid waste haulers.
   (C)   Map. A map showing the collection day for each street is on file with the City Clerk and is incorporated by reference.
   (D)   Time and location. No person shall place any solid waste or receptacles on any terrace earlier than 4:00 p.m. on the day prior to the regular and customary collection schedule, nor any later than 6:00 a.m. on the day of solid waste pickup. The receptacles are to be removed from the terrace not later than 12:00 midnight on the day that they are emptied. At all other times the solid waste and receptacles shall be stored within the rear yard or in the side yard located behind the front building line of the property, except durable plastic bags, which shall be stored in an enclosed building until lawfully set out on the terrace for collection in conformance with the requirements of this chapter.
      (1)   Under other and special circumstances, receptacles may be placed on the city right-of-way after first securing permission from the Department of Community Development.
      (2)   The city solid waste collection and disposal service may be delayed one day throughout the week following a holiday. The eligible holiday listings for each year are on file with the Community Development Department.
   (E)   Requirements for disposal. Any owner or occupant eligible to utilize the city’s refuse service shall do so in the following manner:
      (1)   (Reserved.)
      (2)   All refuse shall be thoroughly drained of all liquid;
      (3)   Sharp objects should be securely wrapped for safety;
      (4)   Ashes shall be extinguished so that no hot coal or fire remains;
      (5)   Solid waste must be placed in a proper receptacle and shall not exceed 50 pounds in weight;
      (6)   Yard waste and brush must be separated from all other solid waste, and in an approved yard waste receptacle or properly bundled;
      (7)   Construction or demolition debris shall not be mixed with brush and yard waste. Items such as boards and plywood must be bundled;
      (8)   Oversized items may be placed out for collection on the scheduled pick-up service day as long as all doors, refrigerant gas or freon are removed and they are in conformance with all other requirements of this chapter. One oversized item and one white good may be placed out for collection each month without charge on the scheduled pick-up day; additional items placed out will need an oversized waste sticker applied; and
      (9)   Recycling materials are to be placed in a recycling receptacle.
   (F)   Overloaded receptacles. Any receptacle in which the volume of contents prevents full closure of the cover, solid waste piled near, on the exterior or above the sidewalls of the receptacle shall evidence an overload condition. Overloaded receptacles shall be remedied immediately by the property owner, agent, occupant, responsible party or person and thereafter supplemented by additional pickups and/or receptacles to prevent any recurrence of the overload condition and to maintain the premises in a safe, clean and sanitary manner. The owners shall promptly provide written verification of additional pickups and/or receptacles from their private waste hauler contractor to the city upon a request for the same.
   (G)   Yard waste and brush. When bundled or placed in a proper receptacle in accordance with this chapter, yard waste and brush will be collected during the months of March through November on a weekly basis. During the months of December, January and February collection shall be once each month, as designated by the City Manager.
   (H)   Special pickup. Placing solid waste on the terrace in violation of any part of this chapter shall result in a special pickup of the refuse and charges as established in § 50.40.
   (I)   Rummaging. It shall be unlawful for any person, other than the city’s solid waste hauler or any other authorized city employee, to collect, obtain, possess, rummage through or pick-up any items placed on the terrace for collection
   (J)   Unacceptable items. Those items that are not allowed in landfills by federal or state law, or regulations imposed by the county landfill, city or the city waste hauler, shall not be placed on the terrace for collection.
