§ 50.40 ESTABLISHING BILLING.
   (A)   Solid waste rates and charges. All one-family, two-family and three-family dwelling water users, within the city limits, shall have added to the utility bills issued by the city the sum of $24.29 per month, per dwelling unit, to be used for the financing of the collection and disposal of solid waste; provided, however, that owners of multi-family structures containing four or more dwelling units may elect to either use the solid waste collection and disposal services provided by the city and pay at a rate of $24.29 per month for each dwelling unit, or the owners may elect to dispose of the solid waste by private waste hauling contractor, in which latter event, they will not be charged a collection and disposal fee by the city.
   (B)   Late payment penalty. In the event the solid waste rates and charges that are added to the city utility bill are not paid within the time specified in the water ordinance, a late payment penalty fee in the amount of 10% of the solid waste rate or charge shall be added to and collected with the utility bill.
   (C)   Disconnection of water. In the event the solid waste bill, including the late payment penalty fee, is not paid by the water user within the time specified in the water ordinance, the city is authorized to discontinue water service to the premises in accordance with the terms of the water ordinance, and to discontinue collection of solid waste from the premises.
   (D)   Users not billed for city utilities. In the event the service of collecting and disposing of solid waste is furnished to a person who is not billed for the use of utilities by the city, the person shall be charged for the service as set forth in division (A) above. If the bill for the service is not paid when due, a late payment penalty fee in the amount of 10% of the refuse disposal bill shall be added to and collected with the utility bill and if the bill, including the late payment penalty fee, is not paid by the time specified in the water ordinance referenced in (C) above, the service shall be discontinued to that person.
   (E)   Lien. The city will take appropriate legal action on all unpaid charges for the collection and disposal of solid waste. If a bill remains unpaid by the statement or invoice due date, the city shall proceed to record a lien upon the subject real estate in the office of the Recorder of Deeds of this county, as provided in § 11-20-13 of the Illinois Municipal Code (ILCS Ch. 65, Act 5, § 11-20-13) as now in force and hereafter amended.
   (F)   Special pickup charge. The charge for a special pickup and an administrative fee will be billed to the tax bill owner listed on the City Assessor’s records. In the event the charge is not paid within the time specified in the billing statement, a late payment penalty will be added to the bill. If the bill and latepenalty have not been paid, a lien will then be filed against the property for the amount of all charges.
