§ 93.09 NOISY ANIMALS; NUISANCE; VICIOUS ANIMAL.
   (A)   Noise disturbances.
      (1)   No person shall keep any animal which causes frequent or long continued noise or otherwise so as to disturb the comfort or repose of any person in the vicinity.
      (2)   Any violation of this section is declared to be a nuisance and as such may be abated.
   (B)   Keeping nuisance or vicious animal. No person shall keep any animal which is a nuisance or is vicious, as defined in this chapter.
   (C)   Disposition of nuisance or uncontrollable animals. If an animal is found by the Municipal Court Judge, upon notice and hearing, to be uncontrollable by its owner or harborer to the extent that such animal poses a threat to the health, safety and welfare of the public, then such animal shall be ordered removed from the town limits or destroyed, at the owner’s option, within ten days of the order. Such a finding by the Municipal Court Judge shall be based upon, but not limited to, evidence of three convictions, pleas of guilty or nolo contendere (no contest) of violations of §§ 93.06 or 93.11(B) and this section against or by the current owners or harborers within a 12-month period concerning the same animal.
