§ 93.06 RUNNING AT LARGE; CITING OWNER; CONFINEMENT.
   (A)   Running at large prohibited.
      (1)   No owner shall permit any animal, including fowl, owned, harbored or kept by him or her, to be at large within the town.
      (2)   It is unlawful for any animal to be at large within the town.
   (B)   Confinement required; means of confinement.
      (1)   Every person who owns, possesses or harbors any dog within the town shall confine the dog to property owned or controlled by him or her.
      (2)   Confinement shall be accomplished by means of a substantial fence or similar enclosure of sufficient strength and height to prevent the dog from escaping therefrom, or from extending its head through the enclosure, or by keeping the dog inside a house or other building.
   (C)   Tethering conditions and restrictions.
      (1)   Dogs not confined in enclosures may be confined by a tether. Such tether shall consist of a metal chain or other material of sufficient strength to prevent the dog from escaping the property.
      (2)   The tether shall be long enough to permit the dog to have reasonable exercise but shall not allow the dog access to public property or sidewalks or rights-of-way or to property owned by or leased by persons other than the owner of the animal.
      (3)   It shall be unlawful for any person to tether an animal at any time in a manner that unreasonably limits the dog’s movements.
      (4)   The tether shall not use a collar that is pinch type, prong type or choke type, or that is not properly fitted to the dog.
      (5)   The tether shall be a length shorter than either five times the length of the dog, or ten feet in length.
      (6)   The tether shall not:
         (a)   Be in an unsafe condition;
         (b)   Cause injury to the dog; or
         (c)   Exceed one-twentieth of the dog’s body weight.
   (D)   Impoundment; citing owner. Any animal running at large in the town may be taken up and impounded at the animal shelter. The animal control officer may, at his or her discretion, cite the owner of such animal to appear in Municipal Court to answer charges of violation of this chapter.
