§ 130.58 EXCEPTION - BURNING YARD WASTE.
   It shall be unlawful to burn weeds, leaves, grass and any other yard trimmings or yard waste (herein collectively "yard waste") except as permitted under the following restrictions:
   (A)   It shall be lawful to burn yard waste in the city on Tuesday, Thursday and Saturday only, between the hours of 6:00 a.m. through 6:00 p.m. No burning shall be permitted at any time under this exception on any Monday, Wednesday, Friday or Sunday.
   (B)   Burning of yard waste shall not be conducted within 25 feet of any structure or other combustible material.
   (C)   A garden hose or a bucket of water shall be readily available for use at the burning site.
   (D)   Burning yard waste shall be constantly attended by a competent person until the fire is completely extinguished.
   (E)   No person shall kindle, maintain or cause to be kindled or maintained, any fire on or within two feet of any city right-of-way, street, avenue, alley, drainage ditch, easement or park.
   (F)   The Fire Chief or his or her agent may prohibit burning of yard waste when atmospheric conditions or local circumstances make such fires hazardous.
   (G)   Burning of yard waste shall not create a visibility hazard on any street, alley, sidewalk, railway or public right-of-way.
   (H)   All dry yard waste allowed to be burned under this section shall be burned on the premises on which such yard waste is generated.
