§ 91.03 EXCEPTIONS.
   (A)   Motor vehicles and chain saws are excepted from the operation of § 91.02 of this chapter, provided an original equipment-type muffler, silencer or spark arrester is properly attached and functioning and no bypass or defeat mechanism is present. In such instances, however, the operator must take precautions to minimize the sound by maintaining reduced throttle settings where possible and minimizing use in public places.
   (B)   This section shall not apply to the use of “jake brakes,” which may be used only in emergency situations.
